Service Terms

1. These terms and your SOW

These Service Terms apply to every branding, designing and growth engagement between 3Anomaly, a business based in Pune, Maharashtra, India (“3Anomaly”, “we”, “us”, “our”) and you, the client. Each engagement is described in a proposal or statement of work (“SOW”). If the SOW and these terms conflict, the SOW applies to that engagement.

2. Scope and changes

We deliver the services set out in the SOW. Work outside that scope is a change request. We’ll estimate the hours before starting, and change requests begin only after you approve them in writing; email is fine.

3. Hours and fees

• Our standard rate is ₹2,500 per hour, unless your SOW states a different rate. Packages are expressed as hours per month.
• We log time as we work and share an itemised log of hours every cycle: what was worked on, by whom and for how long.
• Unless your SOW says otherwise, retainers are invoiced monthly and invoices are due within 15 days.
• Fees are exclusive of GST and other applicable taxes, which are added to invoices where they apply.
• Third-party costs, including advertising spend, software, licences, hosting, stock images and fonts, are paid by you directly or reimbursed at cost. We’ll agree them with you before they’re incurred.

4. Minimum term and ending an engagement

• Every engagement has a minimum term of three months, unless your SOW says otherwise.
• After the minimum term the engagement continues month to month. Either of us can end it with 30 days’ written notice.
• Either of us can end an engagement straight away if the other seriously breaches these terms and doesn’t put it right within 14 days of written notice.
• When an engagement ends, you pay for hours worked and costs committed up to the end date. We hand over completed work and documentation once those amounts are paid. Refunds are covered by our Refund & Cancellation Policy.

5. Your responsibilities

• Give us timely access to the people, information, accounts and materials we need.
• Give consolidated feedback and approvals within the timeframes we agree.
• Make sure anything you give us, such as logos, copy, images and data, is yours to use or licensed for this use.
• Review deliverables for accuracy and for compliance with the laws and rules that apply to your industry before you publish them.

If a delay on your side holds up the work, timelines move by at least the same amount.

6. Feedback and approval

We work in review cycles agreed at kickoff. A deliverable is approved when you approve it in writing, or 10 business days after we deliver it if we haven’t received feedback.

7. Intellectual property

• Your final work. Once all fees for an engagement are paid, you own the final approved deliverables we created for you, including the rights to use, change and register them.
• Our know-how. We keep ownership of our methods, tools, templates, code libraries and unused concepts. Where any of these form part of a deliverable, you receive a perpetual, non-exclusive licence to use them as part of it.
• Third-party assets. Fonts, stock images, plugins and software remain under their own licences, which we’ll point out to you.

8. Portfolio

We’ll only feature your work in our portfolio, case studies or talks with your written approval, and we’ll respect any confidentiality you ask for.

9. Confidentiality

Each of us will keep the other’s non-public information confidential, use it only for the engagement and protect it with reasonable care. This continues for three years after the engagement ends. We’re happy to sign a separate NDA before you share anything sensitive.

10. Data protection

Where we handle personal data on your behalf, for example in your analytics, CRM or email tools, we act only on your documented instructions, apply appropriate security and help you meet your obligations under the DPDP Act and other laws that apply. A data processing agreement is available on request.

11. Results

We do the work with skill and care. Rankings, traffic, AI visibility, leads and sales depend on factors outside our control, including changes by search engines and platforms, so we don’t guarantee specific results unless your SOW says so in writing.

12. Liability

Neither of us is liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for an engagement is limited to the fees you paid for it in the 12 months before the claim. Nothing here limits liability that can’t be limited by law.

13. General

We work as independent contractors. Neither of us is responsible for delays caused by events beyond reasonable control. These terms are governed by the laws of India, and the courts at Pune, Maharashtra have exclusive jurisdiction. Notices are sent by email to the addresses in the SOW, or to [email protected].
